AG Koster sues home construction firm for violating Missouri’s No Call law
Jefferson City, Mo. – January 14, 2015 – (RealEstateRama) — Attorney General Chris Koster today announced that his office has filed a lawsuit against Abelard Construction Missouri, LLC, for violating Missouri’s No Call law. Abelard Construction Missouri, LLC is a St. Louis County based franchise of Abelard Construction, a home repair company with franchisees operating in several states.
According to the lawsuit filed in St. Charles County Circuit Court, in July 2013 Abelard Construction Missouri called consumers in St. Charles County with telephone numbers registered on the Missouri No Call list to solicit home repair services. When several consumers advised the company their telephone numbers were registered with the No Call list, the caller disputed the information.
“Missourians who place their numbers on the No Call registry should expect that solicitors will respect their request for privacy,” said Koster. “This company illegally called consumers who had registered with the No Call list, and then blatantly lied to those consumers, stating untruthfully that their telephone numbers were not registered on the list.”
Koster is seeking up to $5,000 per violation of the Missouri No Call law. In addition, Koster is asking the court to prohibit Abelard from making any further telephone solicitations in Missouri, and is seeking recovery of the costs of the investigation and prosecution of the case.
Koster reminded Missourians they can register their landline or cellular telephone numbers with the Missouri No Call Registry online or by calling 1-866-662-2551. Consumers who have registered for the No Call list but receive solicitation calls should file a complaint at 866-Buzzoff (866-289-9633).
